All funding is subject to application, approval, and verification of information. Not all applicants will qualify for funding, and approval is at our sole discretion.
Application and Approval Process
Information Accuracy
You agree to provide accurate, complete, and current information during the application process. Providing false or misleading information may result in denial of funding, termination of services, and potential legal action.
Evaluation and Underwriting
We reserve the right to evaluate all applications using our internal underwriting criteria. Funding decisions are based on multiple factors including but not limited to business history, revenue, creditworthiness, and financial stability.
No Guarantee of Approval
Submission of an application does not guarantee approval or funding. We may request additional information or documentation at any time during the evaluation process.
Funding Terms and Repayment
All funding agreements are subject to specific terms outlined in your funding agreement or promissory note. These terms will include:
- Funding amount
- Repayment schedule and amount
- Interest rate or factor rate (if applicable)
- Fees and charges
- Default provisions
- Collateral requirements (if applicable)
You agree to review and sign a formal funding agreement before funds are disbursed. The terms in your funding agreement supersede any general statements made on our website or in marketing materials.
SMS Terms & Conditions
If you opt in to receive SMS or text messages from LASHLEY MGMT LLC, the following additional terms apply:
Program Description
By opting in, you agree to receive recurring marketing and promotional text messages from LASHLEY MGMT LLC about our funding products, services, special offers, and business updates. Messages will be sent using an automated telephone dialing system (ATDS).
Message Frequency
Message frequency varies based on your activity and our promotional schedule. You may receive up to 4 messages per month. We reserve the right to adjust message frequency.
Message and Data Rates
Standard message and data rates may apply based on your mobile carrier's plan. Please consult your mobile carrier for details on your plan and applicable charges.
Opt-Out / Unsubscribe
You can cancel the SMS service at any time by replying STOP to any text message you receive from us. After you send the message STOP, we will send you a confirmation message. You will no longer receive messages from us. If you want to rejoin, sign up again through our website or reply START.

No Condition of Service
Your consent to receive text messages is NOT a condition of purchasing or using any of our services. You may contact us through other channels and still receive full access to our funding services.
Supported Carriers
Our SMS program works with all major U.S. carriers including AT&T, Verizon Wireless, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.
Privacy
Your mobile phone number and opt-in consent will be used in accordance with our Privacy Policy. We will not share your mobile information with third parties for marketing purposes.
User Responsibilities
When using our services, you agree to:
- Provide accurate and truthful information
- Maintain the confidentiality of any account credentials
- Notify us immediately of any unauthorized use of your account
- Use our services only for lawful business purposes
- Comply with all applicable federal, state, and local laws
- Make timely payments as agreed in your funding agreement

Limitation of Liability
To the fullest extent permitted by law, LASHLEY MGMT LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.
Our total liability for any claims arising from your use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the liability.

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
Arbitration
Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. The arbitration shall take place in Cleveland, Ohio. You agree to waive your right to a jury trial and to participate in class action lawsuits.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with your funding agreement and our Privacy Policy, constitute the entire agreement between you and LASHLEY MGMT LLC regarding the use of our services and supersede all prior or contemporaneous communications and proposals.
